South Korea Strengthens Pension Rules for Foreign Residents: Strictly Limits Retroactive Payments
The Ministry of Health and Welfare and the National Pension Service (NPS) have revised guidelines to prevent the misuse of retroactive pension payments (Chunap) by foreign nationals. The updated rules require strict proof of actual residence in South Korea.
Key Changes to Retroactive Payment (Chunap) Rules
Actual Residence Required: Effective August 31, eligibility is based on actual days spent in Korea—not simply holding visa status or alien registration.
15-Day Rule per Month: To count a month toward eligibility, foreign applicants must prove they physically resided in South Korea for at least 15 days during that month.
Mandatory Documentation: Applicants must submit an Entry & Exit Certificate alongside marital relationship documents to verify physical stay.
No Payments for Period Overseas: Retroactive payments for periods spent outside South Korea are strictly prohibited.
Upcoming Legal Changes & Follow-up Controls
Reciprocity Principle: Legal revisions will soon restrict retroactive payments strictly to citizens of countries that allow South Korean nationals overseas to make similar pension contributions.
Overseas Beneficiary Checks: Verification checks for overseas pension recipients will increase from once a year to twice a year to confirm eligibility and status.
These measures ensure that the National Pension system fairly serves long-term residents and protects retirement income security for eligible contributors.
